On March 22, 2024, the Federal Council decided that there would be no mediation committee for the new cannabis law. Only Saxony advocated convening such a committee, while even Bavaria, known for its conservative stance, refrained from taking this step. The next phase in the legislative process now involves signing by the Federal President and publication in the Federal Law Gazette. However, this formality could be delayed due to the Federal President’s absence from March 25th to April 3rd, so the signing is not guaranteed, especially on April 1st
Legalization raises numerous questions, to which we have already collected many answers. We invite you to ask additional questions or leave comments to foster a comprehensive discussion. An initial assessment of the law is planned one year after it comes into force, with results published by the end of September 2025. Further assessments are planned after two and four years.
As part of legalization, the federal government also intends to start a model project in which cannabis will be sold in selected regions under scientific support and state control. This model project aims to gain the EU’s approval and is based on similar projects that have already been carried out in Switzerland for several years. Given the political landscape, the CDU is indicating that it would reverse legalization if it wins the election, although it remains unclear how quickly this could be implemented. It is hoped that after this significant progress there will be no regression in Germany’s cannabis policy.
As cannabis laws evolve, many patients wonder how legalization will impact their access to medical cannabis. While every country or region has its own regulations, here are some common changes medical cannabis patients might experience after legalization:
Increased Access & Availability
Legalization often leads to more dispensaries and retail locations selling cannabis products. However, medical patients may still have access to exclusive products or formulations tailored for specific conditions.
Potential Cost Changes
In some cases, medical cannabis may become more affordable if competition increases. On the other hand, if taxation applies to all cannabis sales, some prices could rise. Many regions keep medical cannabis tax-free or at a reduced rate to ensure affordability.
Quality & Product Selection
With legalization, more brands and products enter the market, but medical-grade cannabis often maintains stricter standards. Patients should continue consulting with healthcare providers to choose the right products for their needs.
Doctor’s Prescription & Medical Guidance
Even after legalization, having a medical prescription may provide benefits such as legal protection, higher purchase limits, or access to stronger dosages not available for recreational users.
Workplace & Legal Protections
Some regions offer legal protections for medical cannabis patients that don’t apply to recreational users. Patients should stay informed about employment policies and legal rights regarding cannabis use.
Insurance & Healthcare Coverage
In some cases, medical cannabis may be covered under health insurance, while recreational cannabis is not. Legalization might encourage more insurance companies to recognize cannabis as a medical expense.
A Cannabis Social Club (CSC) or Cultivation Association is a non-profit organization where members collectively grow and share cannabis for personal use, usually within a regulated framework. These clubs operate under the principle that cannabis use should be a private, community-driven activity rather than a commercial industry.
Key Features of Cannabis Social Clubs & Cultivation Associations:
Non-Profit & Member-Based
Members contribute to the club’s expenses rather than purchasing cannabis as a commercial product.
Only registered members can participate, and they usually must be adults with legal access to cannabis.
Closed & Private System
Cannabis is cultivated and distributed only within the club—it is not sold to the public.
Membership is typically limited to prevent large-scale distribution.
Responsible & Safe Consumption
Clubs promote safe and informed cannabis use.
They often provide educational resources on dosage, strains, and effects.
Legal & Regulatory Considerations
Some countries or regions allow CSCs under personal use laws, while others restrict or ban them.
Clubs must comply with local cannabis laws, including limits on plant cultivation and member restrictions.
Common Regulations for Private Cultivation
These are typical rules governments impose when allowing home-growing:
Number of Plants
Limits per person or household (e.g., 3–6 plants)
Sometimes lower for people under 21 or banned entirely for them
Plant Use
Must be for personal use only, not for sale
Often within a closed, private space (e.g., home, garden not visible from the street)
Security Measures
Plants must be secured from children and the public
Sometimes required to grow indoors or in locked areas
Odor Control & Neighbors
Some regions require odor control or discretion
Nuisance complaints can lead to forced removal
Registration or Notification
In a few countries (like Malta or future Germany), growers may need to register with authorities or a club
Penalties for Overstepping
Exceeding the plant limit, selling, or having poorly secured setups can lead to fines or criminal charges—even if cultivation itself is legal

The costs associated with membership in a cannabis social club (CSC) can vary quite a bit depending on the country, local regulations, and the club’s internal structure. But generally, here are the common costs you might encounter:
1. Membership Fee
Most clubs charge a yearly or monthly membership fee. This usually covers administrative costs, legal protections, and sometimes access to club events or shared spaces.
2. Contribution for Cannabis
CSC members don’t “buy” cannabis in a commercial sense. Instead, they contribute to the cost of cultivation and production, which is how clubs stay within legal gray zones in countries like Spain.
🇩🇪 Germany – NEW Law from April 1, 2024
Germany legalized limited cannabis use under new legislation:
Private possession:
Up to 25 grams on your person in public
Up to 50 grams in private spaces (like your home)
Cultivation:
Up to 3 plants per adult for personal use
Cannabis clubs (starting July 1, 2024):
Members can receive up to 50g/month, or 30g/month for under 21s
General Rule
- Cannabis may be legal to possess and use,
But not legal to consume in publicEPublic use is allowed but with restrictions:
Not in pedestrian zones during daytime (7am–8pm)
Allowed in private spaces or designated cannabis clubs
Not near schools, playgrounds, or sports facilities (within 100 meters)
After legalization, minors (usually under 18 or 21) are still heavily protected under cannabis laws. Legalization is typically aimed at adult, responsible use, and governments make it very clear that minors cannot access or consume cannabis.
Key Regulations for Cannabis and Driving Under the Influence
Blood THC Limits
Many regions impose a legal limit for THC in the blood while driving, similar to blood alcohol concentration (BAC) laws for alcohol.
The limit varies but is typically set around 2 to 5 nanograms of THC per milliliter of blood.
Higher levels of THC in the blood may result in automatic DUI charges or criminal penalties.
Driving While Impaired
Even if an individual has less than the legal limit of THC in their blood, they can still be charged if they are deemed impaired while driving.
Impairment is judged based on physical signs (e.g., erratic driving behavior, slow reaction times) and field sobriety tests (such as coordination tests or breath tests in some regions).
Enforcement
Police officers are often trained to recognize signs of cannabis impairment through field sobriety tests, including observing behavior like:
Bloodshot eyes
Difficulty speaking or coordinating motor skills
Slow reaction times
In some areas, oral fluid tests or blood tests may be used at roadside checkpoints to detect THC levels.
In cases of suspected impairment, drivers may be asked to take a blood or saliva test to determine THC concentration.

Penalties for Cannabis DUI The penalties for driving under the influence of cannabis can range from fines to license suspension to jail time, depending on the severity of the offense and the region’s laws. Penalties typically include:
Fines: Monetary fines are common, often increasing with repeat offenses.
License Suspension: Temporary or permanent suspension of the driver’s license.
Jail Time: Severe cases, especially with high THC levels or repeat offenses, may result in imprisonment.
Safer Consumption
Legalization allows for regulated products (e.g., THC levels, purity, labeling) that are safer than cannabis obtained through the black market. This reduces risks from contaminated cannabis or dangerous substances that could be added by illegal suppliers.
Job Creation and Industry Growth
Cannabis legalization creates a new industry with significant job opportunities in cultivation, manufacturing, distribution, retail, and research. This can provide a boost to local economies and tax revenues.
Tax Revenues
Governments can tax legal cannabis sales, which can provide a substantial revenue stream. These funds can be allocated toward public health, education, substance abuse programs, or general public services.
Tourism
Legal cannabis can boost tourism in areas where consumption is allowed, with people visiting to experience cannabis-friendly environments (e.g., dispensaries, cannabis lounges, festivals).

In many places where cannabis has been legalized, cannabis-related criminal records—particularly those for possession of small amounts or non-violent offenses—are being erased or expunged. However, whether this happens depends on the specific provisions of the legalization law in each jurisdiction. Here’s an overview of how expungement or erasure of cannabis criminal records works in regions where cannabis has been legalized
The penalties for possession of cannabis in excess of the permitted amount depend on the region or jurisdiction, as each location has its own legal limits for personal possession and different penalties for exceeding those limits. Here’s an overview of how the penalties typically work in regions where cannabis has been legalized or decriminalized :
Germany
Personal Use vs. Trafficking: The authorities will often differentiate between personal use and trafficking based on the quantity of cannabis and other factors, such as packaging or intent. However, even minor overages could be scrutinized, especially if there are signs of distribution.
Confiscation: If you exceed the limit, the authorities will likely seize the cannabis, even if no criminal charges are filed.
Cannabis and Road Traffic Regulations After Legalization
1. Driving Under the Influence (DUI) of Cannabis
Cannabis consumption impairs motor skills, reaction time, and judgment, so driving under the influence is illegal even in areas where cannabis is legal for personal use.
Driving while impaired by cannabis can lead to serious consequences, including fines, license suspension, and imprisonment.
2. Legal Limits for THC Concentration in Blood
Many regions that have legalized cannabis have established legal limits for the amount of THC (tetrahydrocannabinol, the psychoactive compound in cannabis) that a driver can have in their system while operating a vehicle.
Example Limits:
Canada: As of legalization in 2018, the legal limits are set at:
2-5 nanograms of THC per milliliter of blood: Fines and possible suspension.
Over 5 nanograms per milliliter: More serious penalties, including criminal charges.
United States: The limits vary by state:
For example, Colorado has set a legal limit of 5 nanograms of THC per milliliter of blood for drivers. States like Washington also have a similar threshold.
Some states, like California, do not have a specific limit but instead consider impairment as the key factor in determining DUI charges.
Germany: THC limits vary, but generally, any measurable amount of THC in the blood could result in DUI charges. There are no clear legal thresholds like those in Canada and the U.S., and even small traces can lead to serious penalties if impairment is evident.
The free trade of cannabis in specialist shops depends heavily on the country, region, and local laws governing cannabis trade, even in places where cannabis has been legalized for recreational use. After cannabis legalization, the sale and distribution of cannabis are generally regulated to ensure quality control, taxation, and public safety.
